Workers' rights
In Canada, all workers have rights, no matter their immigration status. These rights are protected under Ontario law, including the Employment Standards Act (ESA) and workplace health and safety regulations.
You have the right to:
- Be paid at least the minimum wage
- Work in a safe and healthy environment
- Be free from harassment and discrimination
- Take breaks, vacation, and sick leave as provided by law
- Receive overtime pay when eligible
- Join a union if you choose
- Take job-protected leaves (such as parental or medical leave)
Your employer cannot take away your rights or make unfair deductions from your pay because of your immigration status.
If you have concerns at work
Most employers in Waterloo Region treat their employees fairly. If you have concerns or are unsure about a situation, you can:
- Speak with your supervisor, if it is safe to do so
- Keep a record of what happened, including dates and details
- Talk to a settlement worker or another trusted support person
Get support and report concerns
You are not alone. Support is available:
- Ministry of Labour, Immigration, Training and Skills Development
- Workplace Safety and Insurance Board (WSIB) for workplace injury benefits and support
If you are injured at work:
- Report the injury to your employer as soon as possible
- Contact WSIB to access support and benefits
